A middle school teacher remains behind bars in connection with the alleged sexual assault of one of his students.
Osbaldo Garza, an ROTC teacher at A.P. Solis Middle School went before a Donna municipal judge Tuesday afternoon. Garza was charged him with one count of online solicitation of a minor, one count of sexual assault of a minor and one count of improper teacher student relations. The judge set Garza’s bond at $150,000 and sent him to the Hidalgo County Jail.
Sexual assault of a minor and improper relationship between teacher and student both are second-degree felonies punishable by two to 20 years in prison if convicted. Online solicitation of a minor is a third-degree felony punishable by two to 10 years in prison if convicted.
Donna ISD superintendent Roberto Loredo stated that the district received information about the case on March 20 and immediately suspended Garza without pay while the school district police department conducted an investigation into the matter.
“He was arrested yesterday and taken before a judge,” Loredo said. “The district is continuing the investigation and once it’s concluded, we will come to a determination as to his employment situation.”
Information released by authorities is unclear about the specifics of the case; however, the alleged relationship between Garza and a female student may have been ongoing.
Investigators were going through the phone text messages to document the incident.
Loredo said it doesn’t appear at this point that other students were involved.
